Swimming pool construction regulations
In France, the regulations and requirements differ depending on the surface area of the pool. So let's take a look at the requirements according to size.
Surface area less than 10 m²
Some types of pool do not require any special formalities, notably in-ground pools and pools with a surface area of less than 10 m². Inflatable or tubular pools and those located inside existing buildings that do not require structural modifications are also exempt from special measures. However, all construction work must be notified in advance to the relevant authorities, in particular the town planning department.
Surface area between 10 and 100 m²
If you are building a swimming pool with a surface area of between 10 and 100 m², you will need to make a prior declaration of building work. You must also complete the cerfa form n° 13703*06. In addition to all the documents listed on the form, two copies of the declaration must be submitted.
Surface area over 100 m²
Planning permission is required for the construction or conversion of above-ground swimming pools with a surface area of more than 100 m². To avoid negative responses to your applications for planning permission on land that is being developed, the pool must be located at least 3 metres from the neighbour's fence.
However, it is possible to reduce this distance in accordance with the terms of the PLU in force in the municipality. For this type of pool, 4 copies of your application must be submitted in addition to the required documents.
Other important information
If a swimming pool does not have planning permission, the development is considered illegal. The construction of swimming pools constitutes a capital construction project. Registration for the construction of these facilities is regulated by law. Documents confirming ownership of the land, a rental contract and a free use agreement are important.
To guarantee good water quality, regulations pay particular attention to the organisation and implementation of water treatment processes. This includes water purification and disinfection methods.
Failure to comply with these conditions can result in a fine of between €1,200 and €30,000 and six months' imprisonment.
What do I need for planning permission?
An application for planning permission requires a number of documents, which may vary from one zone to another:
- An official site plan prepared at least 90 days in advance is required;
- A copy of the privatisation list or owner's declaration ;
- Names and addresses of neighbours affected by the construction ;
- A technical design permit ;
- A statement from the designer;
- Approval in principle from the Water and Sewerage Authority;
For public swimming pools, approval from the health authority is required.
